Urgent Action: Enforced disappearance of Fidencio Gómez Sántiz (indigenous member of Frente Nacional de Lucha por el Socialismo, FNLS) in Ocosingo, Chiapas

Estamos enterados de la desaparición forzada, en Ocosingo, Chiapas, del indígena Fidencio Gómez Sántiz, miembro del Frente Nacional de Lucha por el Socialismo / We are aware of forced disappearance in Ocosingo, Chiapas, the indigenous Fidencio Gomez Santiz, a member of the FNLS

Por lo cual, exigimos a las autoridades mexicanas:

  • Tomar de manera inmediata las medidas apropiadas para garantizar la seguridad e integridad física y psicológica del indígena Fidencio Gómez Sántiz y de sus familiares, iniciando la búsqueda inmediata y que sea presentado con vida.
  • Realizar una investigación inmediata, exhaustiva e imparcial sobre los hechos descritos, y que los resultados de la investigación se hagan públicos y que los responsables de esos hechos comparezcan ante la justicia.
  • Desmantelar al grupo paramilitar “Los Petules”, investigar y sancionar a los agentes estatales responsables de crear, financiar, entrenar y/o proteger a los paramilitares de dicho grupo.
  • De manera general, conformar sus acciones a lo dispuesto por los Pactos y Convenciones Internacionales de derechos humanos firmados y ratificados por México.

Therefore, we urge the Mexican authorities:

  • Immediately take appropriate measures to ensure the physical and psychological safety and integrity of Fidencio Gómez Sántiz and his family members, immediately initiate a search, and bring him back alive.
  • Conduct an immediate, thorough and impartial investigation into the events described, and make the results public, as well as bring those responsible to justice.
  • Disband the paramilitary group «Los Petules,» and investigate and punish state agents responsible for creating, financing, training and/or protecting the paramilitaries of the aforementioned group.
  • Obey the provisions of international pacts and conventions relating to human rights already signed and ratified by the Mexican government.

Events:

According to information sent by FNLS’s Comité Popular de Derechos Humanos in Chiapas:

On March 5, 2016 between 15:00 and 16:00 Fidencio Gómez Sántiz was last seen in the Jet Ja bus station, near the market in Ocosingo, Chiapas. According to his wife and son, they dropped him off there and then went to visit relatives. 5 to 8 minutes after saying goodbye to their relatives, his son made a phone call to make sure his father’s trip was going all right. Fidencio did not answer.

After saying goodbye to his wife and son, Fidencio Gómez Sántiz had been on his way to Las Perlas ejido, in the municipality of Altamirano where he and his family reside.

It is worth noting that Fidencio Gómez Sántiz returned to Chiapas after being commissioned to Mexico City (CDMX) by Frente Nacional de Lucha por el Socialismo (FNLS) to denounce the attempted extrajudicial execution in November 2015 of three colleagues: Matias Flores, indigenous Nahuatl from the Comité de Derechos Humanos de las Huastecas y Sierra Oriental (CODHHSO); Jesús Hernández Reyes and Rubicél Hernández García, indigenous Nahuatl, who themselves had been commissioned to Mexico City by the FNLS to denounce the extrajudicial execution of Héctor Sántiz López which had recently occurred in Chiapas.

Background:

It’s important to note that there have been previous urgent actions issued by Comité Cerezo México in which state and federal authorities, as well as the paramilitary group “Los Petules” in both Chiapas and Mexico City have been involved.

AU-05-Chiapas/OCEZ-FNLS—02/noviembre/2015 in which we denounced the extrajudicial execution of Héctor Sántiz López and warned of the risk of more extrajudicial executions against Ramiro Sántiz López, as well as members and family members of the organization Campesina Emiliano Zapata - Frente Nacional de Lucha por el Socialismo - (OCEZ-FNLS) in El Carrizal. The organization Frontline Defenders also emitted an urgent action due to these agressions in November of 2015.

AU-06-DF/-FNLS—07/noviembre/2015 in which we denounced the attempted extrajudicial execution in Mexico City of Matias Flores, indigenous Nahuatl and member of CODHHSO; Jesús Hernández Reyes and Rubicel Hernández García, indigenous Nahuatl, commissioners of the FNLS, who were in Mexico City denouncing the extrajudicial execution of Héctor Sántiz López in Chiapas.

AU-01-Chiapas/OCEZ-FNLS—13/enero/2016 in which we denounced the attempted extrajudicial execution of a minor, who is a member of the OCEZ-FNLS in Cuxuljá, Ocosingo, Chiapas.

Therefore, Comité Cerezo México and Comité Popular de DH del FNLS in Chiapas demand that the Mexican government:

  • Immediately take appropriate measures to ensure the physical and psychological safety and integrity of Fidencio Gómez Sántiz and his family members, immediately initiate a search, and bring him back alive.
  • Conduct an immediate, thorough and impartial investigation into the events described, and make the results public, as well as bring those responsible to justice.
  • Disband the paramilitary group "Los Petules," and investigate and punish state agents responsible for creating, financing, training and/or protecting the paramilitaries of the aforementioned group.
  • Obey the provisions of international pacts and conventions relating to human rights already signed and ratified by the Mexican government.

To national and international agencies that protect human rights:

  • To the extent that your mandates allow, manifest your concern to the Mexican government due to the seriousness of these events, and urge it to heed the aforementioned requests.
